General Provisions and Usage

These Terms of Sale and Use (hereafter the “Terms”) govern access to and use of the Website by any visitor or subscriber (the “Customer” or the “User”) as well as the sale of all subscriptions and related services offered by Sidelines (hereafter “the Company”).

By creating an account, browsing the Website, or purchasing advertising or a subscription, the User agrees to be bound by these Terms. The Company reserves the right to amend these Terms at any time.

The User agrees to use the Website solely for lawful purposes and, in particular, not to:

  • copy or reproduce all or part of the Website;
  • redistribute content for commercial purposes;
  • alter or interfere with the Website’s operation or security;
  • attempt unauthorized access to the Company’s systems.
  • Minors may subscribe only with prior consent from their parent or legal guardian, who will be deemed responsible for compliance with these Terms.

Subscriptions

1  Customers may subscribe online through the Website.

2  Orders are considered final only once confirmed by email from the Company. The Customer must therefore provide a valid, functioning email address.

3  The Company reserves the right to cancel or refuse any order from a Customer with outstanding payment issues or incomplete information.

4  Each subscription offer is described on the Website. Images or illustrations are provided for reference only and are not contractually binding.

5  Subscription prices are displayed in U.S. dollars (USD) and include applicable taxes unless stated otherwise. Shipping fees, if any, are indicated during checkout.

6  Prices may change at any time but will not affect orders already confirmed. Promotional prices apply only during the stated promotional period.

7  Payments may be made: by credit/debit card (Visa, MasterCard, American Express) via secure payment gateway; or through automatic renewal (monthly or annual) using the stored card details, when selected. At payment, the User of the credit card must confirm and warrant that he/she is the legal owner of the credit card or has legal authority from the owner to use the credit card for the Sidelines purchase and is over 18 years old.

8  In case of non-payment or declined authorization, the Company may suspend or cancel access to the Customer’s subscription until payment is resolved. Customers will be notified by email prior to suspension.

Effective Date, Duration, and Termination of Subscriptions

1  Types of subscriptions

Annual subscription – fixed 12-month term for ten (10) print issues and unlimited digital access, automatically renewed unless canceled before renewal date.

2  Activation

Print subscriptions begin upon delivery of the first issue, usually within 4–6 weeks depending on location.

3  Cancellation by the Customer

Customers may cancel at any time through their online Account or by contacting Customer Service at .

Cancellation becomes effective at the end of the current billing period (month or year).

Directory Listings

1  Customers may purchase Directory Advertising online through the Website.

2  To place an ad, the Customer must complete the online registration form, providing accurate and complete information and updating it as needed. False or incomplete data may result in suspension or termination of the Account.  The Customer is solely responsible for the accuracy and correctness of all information in Directory Advertising.  The order process includes:

Selection of Ad Duration

Choice of Payment Method

Validation of Payment and Authorization of Use of Credit Card

Confirmation of Order and Approval of Ad

3  Orders are considered final only once confirmed by approved by the Company. Ads will be reviewed and approved or rejected within seven (7) business days.  The Customer must provide a valid, functioning email address to be contacted to remedy ad errors or omissions.

  1. If a Directory Ad is rejected, payment will be refunded within thirty (30) days.
  2. Print Directory Ads will run in the next available Issue. Please refer to the media kit for ad deadlines.
  3. The Company reserves the right to cancel or refuse any order from a Customer with outstanding payment issues or incomplete information. Ad approval is solely at the discretion of the Company.

Intellectual Property

All editorial content, visuals, photographs, videos, and other materials published on the Website are protected by U.S. and international copyright laws.

Any reproduction, adaptation, or redistribution without prior written consent from Sidelines  is strictly prohibited, except for limited personal or educational use with clear source attribution.

Data Protection and Privacy

Sidelines is committed to safeguarding the privacy of its Users. We will not share your personal information with other individuals or organizations without your permission except when applicable by law.

Personal data may be collected to process subscriptions, payments, deliveries, and customer relations.  This data may be shared with service providers involved in these operations but will never be sold to third parties.

Sidelines does not sell, rent, or lease any individual’s personal information or lists of email addresses to anyone for marketing purposes, and we take commercially reasonable steps to maintain the security of this information. However, Sidelines reserves the right to supply any such information to any Partner Organization into which Sidelines is a part or may merge in the future.

Cookies: The Website uses cookies to improve navigation and measure audience metrics. Customers can disable cookies in their browser settings, though this may affect certain features.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, Ulster County, without regard to conflict-of-law principles. In the event of a dispute over the enforcement of this agreement, the parties will make best efforts to resolve the dispute among themselves. In the event that is not possible, any dispute must be litigated solely in the courts of Ulster County, NY.
